The article of the assistant attorney Dzmitry Babolia was published in the July issue of the of the journal “I am the legal adviser of the organization”. The article deals in detail with cases in which it is possible to appeal against the notary writ of execution. In the context of the topic under consideration, answers are given to many specific questions: is it possible to appeal against the notary writ in connection with the failure to notify the debtor of the intention to apply to the notary, is the tacit consent of the debtor the basis for the obtainment of the notary writ, is it possible to recover via the notary writ the interest on money had and received, may a notary collect from the debtor delay interests in the amount as of the date of application for notary writ and etc.
