Arbitrator disclosure: IBA lessons

What arbitrators must disclose — and why doubt is resolved in favour of disclosure.

General Standard 3 of the IBA Guidelines requires disclosure of any circumstances that, in the eyes of the parties, might raise doubts about independence. Doubt is always resolved in favour of disclosure.

The 2024 update refined the Orange and Red Lists. In practice: check connections early, document the check in writing, and disclose even what seems trivial.
